Terms of Sale (TOS) – CRABZ

1. Purpose and Scope

These Terms of Sale (hereinafter referred to as the "TOS") govern the purchase and use of paid services on the CRABZ platform (hereinafter referred to as "the Platform").

They apply separately to the following categories:

  • Users: Any person accessing paid services to consume content or interact with AI.
  • Creators: Any person offering paid content via the Platform.
  • Affiliates: Any person participating in the CRABZ affiliate program by referring users or creators.

The TOS apply together with the Terms of Use (TOU), and any transaction implies their simultaneous acceptance.

A CRABZ account is strictly personal and cannot be sold, transferred, or assigned to a third party.

2. Paid Services and Pricing

2.1 For Users

The paid services available to users include:

  • Prepaid credits: Purchase of packs allowing access to content and interactions.
  • Monthly subscriptions: Privileged access to exclusive content and specific benefits.

Pricing and Taxes:

  • Prices are displayed in U.S. dollars ($USD) and may include taxes depending on applicable legislation.
  • Currency conversion fees may apply depending on the payment method used.

2.2 For Creators

Creators can generate revenue through:

  • The sale of AI-generated audio interactions.

Commissions and Fees:

  • CRABZ applies a commission on each transaction, including:
    • A fixed cost per minute (example: $0.20/minute).
    • A percentage of the amount consumed by the user (example: 40%).
  • All commission details are available in the creator's dashboard.
  • Free credits do not generate remuneration for creators.
  • All transactions are secured through a single payment provider.

Service Activation and Access:

  • Access to paid services is immediate upon payment validation.
  • No retraction or cancellation is possible once the service is used.
  • CRABZ may require age verification before service activation, in accordance with the TOU.

Creator Payments:

  • Payments are made every 15 days according to the schedule set by CRABZ.
  • A minimum withdrawal threshold may be required before any payout (example: $50 minimum).

2.3 For Affiliates

Affiliates can generate revenue through the CRABZ referral program by recommending users or creators to the platform.

Terms:

  • The affiliate program allows earning a commission on user spending or creator earnings.

Commission Payout:

  • The earned amount will be calculated after CRABZ's commission deduction.
  • Payouts follow the same rules as for creators (payment frequency, minimum withdrawal, etc.).

3. Payments and Transactions

3.1 Payment Methods

Payments can be made via:

  • Credit card (Visa, Mastercard, etc.)
  • Cryptocurrency (subject to the currencies supported by our payment processor).

All transactions are secured through a PCI-DSS-compliant payment provider. CRABZ does not store any banking data.

4. Subscription Renewal and Cancellation

4.1 For Users

Renewal: Subscriptions are automatically renewed at the end of each period.

Cancellation:

  • The user can disable automatic renewal via their account settings.
  • They retain access to services until the end of the paid period.

4.2 For Creators

Creators agree that all subscriptions sold are managed exclusively by CRABZ.

Account Deletion:

  • If a creator closes their account, all active subscriptions are canceled.

5. Refund Policy

5.1 No Right of Withdrawal

Due to the digital nature of the services, all sales are final.

5.2 Exceptional Refund Cases

A refund may be granted only in the following cases:

  • Verified technical failure preventing access to the service (not attributable to the user).
  • Billing error (double payment, incorrect charge).

6. Liability and Limitations

  • CRABZ acts solely as a host and is not responsible for content published by creators.
  • CRABZ does not guarantee permanent access and may suspend services for maintenance.
  • CRABZ cannot be held liable for interactions between users and creators.
  • CRABZ is not responsible for service interruptions due to external events (cyberattacks, server failure, force majeure).

7. Fraud, Abuse, and Sanctions

  • Any fraudulent payment or attempt to circumvent the TOS results in immediate account suspension.
  • CRABZ reserves the right to report any suspicious activity to the relevant authorities.

8. Governing Law and Disputes

  • These TOS are governed by the laws of the country where CRABZ is legally registered.
  • In case of a dispute, mediation must be attempted before any legal action.
  • The courts of CRABZ's country of registration have sole jurisdiction.
