Terms of Service (ToS) – CRABZ

1. Introduction

These Terms of Service (hereinafter referred to as the "ToS") govern the access and use of CRABZ (hereinafter the "Platform"), an adult entertainment service facilitating access to erotic audio interactions and multimedia content.

By using the Platform, whether as a User or Content Creator, you fully and unreservedly accept these ToS. If you do not accept them, you must immediately stop using the services.

The use of the Platform's services also implies acceptance of the Terms and Conditions of Sale (TCS), which govern purchase, payment, and refund procedures. Users and Creators are invited to carefully read the TCS available, as their acceptance is required for any transaction on the Platform.

CRABZ acts solely as a content host and not as a direct producer. CRABZ cannot be held responsible for AI-generated content or the exchanges between Users. All interactions are solely the responsibility of the Users. Content Creators are also solely responsible for the content they publish on their profile (photos, videos, texts, etc.).

CRABZ cannot be held responsible for defamatory, racist, hateful, discriminatory, violent, or illegal statements exchanged on the platform. In the event of a serious violation of the applicable laws, CRABZ reserves the right to report the concerned Users or Creators to the competent authorities.

The use of the CRABZ platform implies full and unconditional acceptance of these Terms of Service (ToS). By registering as a User or Content Creator, the individual acknowledges that these ToS constitute a legally binding contractual agreement between them and CRABZ, defining their rights, obligations, and responsibilities. This acceptance constitutes a formal commitment, without the need for a separate contract.

2. Definitions

  • Platform: The website and services offered by CRABZ.
  • User: Any adult accessing the Platform to use the services, with or without a subscription.
  • Content Creator: A person who publishes content or interacts via the Platform.
  • Service: Access to interactive audio exchanges and digital content (photos, videos).
  • User Account: A personal space allowing access to CRABZ services.
  • Credits / Subscription: Payment methods allowing access to services and exclusive content.
  • Intellectual Property: The set of rights related to content published and distributed via CRABZ.

3. Conditions of Access to the Service

3.1. Minimum Age and Verification

Access to the Platform is strictly reserved for adults. By accessing CRABZ, the User and Content Creator certify that they are of legal age in their country, state, or region of residence.

Age verification may be required before accessing the services, including but not limited to:

  • A consent form,
  • The presentation of an identity document,
  • Any other method deemed reasonable by CRABZ.

CRABZ may require in-depth identity verification of Users and Creators at any time. Refusal to comply may result in account suspension or deletion.

3.2. Registration and Account Management

Registration is required to access the services.

  • Users and Creators must provide accurate and verifiable information. Any false statement may result in immediate account deletion.
  • It is strictly forbidden to lend, sell, or share one's account with a third party.
  • The use of unique and secure credentials is mandatory.
  • Account holders are responsible for their security and all activity conducted under their credentials.

3.3. Responsible Use

Users and Creators agree to:

  • Not solicit or attempt to contact a physical person outside the Platform.
  • Follow CRABZ's code of conduct.
  • Not use the Platform for illegal or harmful purposes.
  • Only publish content they fully own and have exclusive rights to. Content creators must only upload photos of themselves, and it is strictly forbidden to upload any media representing another person, whether real or fictional.

4. Intellectual Property and Content Usage

Creators retain ownership of the content they publish themselves (photos, videos, etc.).

However, by accepting these Terms of Service, Content Creators expressly grant CRABZ a global, non-exclusive, royalty-free, and transferable license allowing CRABZ to:

  • Host and store their content on its servers.
  • Publicly display the content on the platform and related services.
  • Use it for internal promotional purposes, limited to showcasing their profile on CRABZ.

Voices and other elements provided via interactions may be used by CRABZ on other platforms to fulfill its missions.

It is strictly forbidden to share or republish any content from CRABZ elsewhere.

Any violation will result in a €500 fine per unauthorized shared content, without prejudice to potential legal proceedings.

5. Moderation and Sanctions

5.1. Code of Conduct

Users and Creators agree to:

  • Not publish or share illegal, violent, discriminatory, hateful, or exploitative content.
  • Not solicit or attempt to contact Creators outside CRABZ.
  • Not infringe the intellectual property rights of content available on the Platform.
  • Not engage in any activity that violates the standards of any card association (including but not limited to Visa, Mastercard, and others).

Any non-compliant behavior may result in suspension or permanent account deletion without notice or refund.

5.2. Warnings and Sanctions

CRABZ applies a progressive warning system:

  • First warning → Temporary account suspension.
  • Second warning → Long-term suspension.
  • Third warning → Permanent account deletion.

A serious violation of the ToS may result in immediate account deletion without prior warning.

CRABZ reserves the right to alert competent authorities in case of a serious breach of applicable laws.

6. Liability and Service Availability

CRABZ does not guarantee permanent and uninterrupted access and cannot be held responsible for the consequences of service interruptions.

CRABZ cannot be held liable for technical failures, bugs, temporary unavailability, or cyberattacks.

CRABZ is not responsible for interactions between Users and Creators or for AI-generated content.

CRABZ reserves the right to suspend or ban an account in case of abuse or fraud.

7. Amendments to the ToS

CRABZ reserves the right to modify these ToS at any time. Any changes will be notified to Users and take effect immediately after publication on the Platform.

8. Governing Law and Disputes

These ToS are governed by the laws of the country where CRABZ is legally registered. In the event of a dispute, an attempt at mediation must be made before any legal action.

CRABZ cannot be held responsible if a User fails to comply with the laws applicable in their country regarding adult content usage.

CRABZ reserves the right to immediately terminate any account in case of a violation of applicable laws in the User's country.

Any dispute shall be settled before the courts of the country where CRABZ is legally established.

9. Legal and Regulatory Obligations of Content Creators

9.1. General Compliance Obligations

All Content Creators on CRABZ agree to comply with the laws, regulations, and best practices in force in their country of residence or activity. This includes, but is not limited to:

  • Age verification of individuals appearing in content,
  • Obtaining informed consent for content distribution,
  • Respecting image rights and privacy,
  • Complying with intellectual property laws,
  • Adhering to applicable data protection regulations,
  • Fulfilling any tax obligations related to earnings generated on the Platform.

Creators are solely and fully responsible for ensuring their own legal compliance. Any violation of these obligations may result in account suspension or permanent deletion.

9.2. Creators Residing or Operating in the United States

If you are a Creator based in the United States, or if you publish content from within the United States, you expressly acknowledge and agree to the following obligations:

  • You act as the legal custodian of records for all content you upload to CRABZ.
  • You are responsible for maintaining complete and accurate documentation proving the identity, legal age, and informed consent of every individual appearing in your content.
  • You are solely responsible for full compliance with 18 U.S. Code § 2257 (Record-Keeping Requirements for Sexually Explicit Content), to the extent that it applies to you.

You warrant that any individual featured in your content:

  • Was of legal age according to the laws of their place of residence at the time the content was created;
  • Has provided clear, informed, and written consent for the distribution of the content on CRABZ;
  • Has submitted a valid government-issued identification, which you are required to retain.

9.3. Limitation of Liability of CRABZ

CRABZ operates strictly as a technical hosting provider for content published by Creators. As such, CRABZ shall not be considered the primary producer under the meaning of 18 U.S. Code § 2257 (Record-Keeping Requirements for Sexually Explicit Content), nor as a co-producer or editor of any content uploaded to the Platform.

CRABZ is not a party to any contracts, agreements, or relationships between a Creator and the individuals appearing in their content, including in the case of co-authored content. The Creator bears full legal responsibility for all content they publish.
